OneSpan Notary FAQ

What is Remote Online Notarization (RON)?

Remote Online Notarization (RON) facilitates the notarization of documents online, without the need for signers and notaries to physically meet in person. The signer uses electronic signatures to complete documents in the presence of a notary via web conferencing software. The remote online notary must validate and authenticate the identity of the signer and record the notarization session.

Is Remote Online Notarization (RON) legal across the United States?

In response to the pandemic and social distancing restrictions, dozens of U.S. state legislatures passed bills allowing for Remote Online Notarization (RON) and to date, more than 40 U.S. states have passed legislation recognizing RON. Laws and regulations that determine how RON services must be carried out will vary on a state by state basis. We encourage you to confirm the legality of RON with your Secretary of State or other body responsible for notary regulations.

Can the signer be in a different state than the notary when remotely notarizing agreements?

Generally, yes. For the most part, the signer can be located outside the notary’s commissioning state, anywhere in the U.S. or internationally when remotely notarizing agreements. The notary public is required to comply with the laws of the state under which they are authorized to notarize the agreements and be seated in a supported state that allows remote online notarizations. Please consult your legal team for more information on this subject.

What does a signer require to perform remote notarization from home?

The signer must have access to a personal computer, webcam, microphone, and a stable Internet connection.

Does OneSpan Notary meet security and compliance requirements for RON?

OneSpan Notary facilitates compliance with US State requirements for RON by providing the features required for notaries to perform remote online notarizations. Digital signatures are applied after each e-signature of the notarized document, producing tamper-evident documents after the online notarization is completed. In addition, each online notarized agreement is accompanied by an eJournal, a recording of the session, and a comprehensive audit trail detailing events that took place during the notarial session.
